Goods sales terms in the Internet store www.beeline.am
1.1. Buyer – person who has intention to purchase, purchases or uses the Goods exclusively for private, family, domestic or other needs not connected with entrepreneurial activities, who places an Order on the web-site www.beeline.am, or who is indicated in the Order as a Buyer.
1.2. Seller –in the framework of the present Terms – “ArmenTel” CJSC, legal address: RA, Yerevan 0014, 2 Aharonyan str.
1.3. Internet-store – Web-site where any Buyer can get acquainted with the presented goods, their features and prices, can choose Goods, place an Order in the procedure set forth by the present Terms, choose the method of paying and receiving the Goods.
1.4. Web-site – set of information resources placed in the Internet at the address: www.beeline.am
1.5. Goods – object of purchase and sale (property) which is not withdrawn or not limited in civil transactions and which is offered for sale in the Internet store. The object of sale can only be the Goods which are indicated in the Internet store as “available” Goods.
1.6. Order – Buyer’s properly completed online request for the purchase of the Goods selected in the Internet store and their receipt at the address indicated in the order/ self-collection from the Seller’s Sales and Customer Care office.
1.7. Seller’s SCCO – Sales and Customer Care offices.
2. General provisions
2.1. The present “Goods sales terms in the Internet store www.beeline.am” (hereinafter referred to as Terms) regulate the relations between the Seller and the Buyer when concluding purchase and sale transactions of the Goods offered for sale in the Internet store, as well as set forth the procedure of Goods purchase and sale via the Internet store, and according to art. 453 of RA Civil Code are considered to be Seller’s public offer addressed to Buyers.
2.2. With regard to the relations between the Buyer and the Seller will apply the provisions of RA CC, RA law “On the protection of consumers rights” and other legal acts taken on the basis and for implementation thereof.
2.3. By purchasing Goods in the Internet store, the Buyer agrees with all the provisions hereof.
The Seller reserves the right to unilaterally make changes and/or amendments herein with preliminary publication on the web-site.
3. Registration and order process
3.1. The Seller does not require from the Buyer to perform special actions to use the resources of the Internet store for viewing the goods, such as registration on the web-site or conclusion of contract on using the Internet store.
3.2. To register on the web-site the Buyer indicates the following mandatory information:
3.2.1. Buyer’s full name
3.2.2. Email address
3.2.3. Mobile number
3.3. The Seller is not liable for the accuracy and correctness of the information provided by the Buyer during registration. The Buyer bears all risks related to the incorrect provision of the required information.
3.4. The Buyer is obliged not to disclose to any third party the login and password chosen by the Buyer during registration.
3.5. Upon completion of the Order on purchasing the Goods in the Internet store the Buyer indicates the following mandatory information:
3.5.1. Buyer’s full name
3.5.2. Email address
3.5.3. Mobile number
3.6. The Seller is not liable for the accuracy and correctness of the information provided by the Buyer when completing the Order. The Buyer bears all risks related to the incorrect provision of the required information.
3.7. The Buyer fills in the corresponding data in the Order in the Internet store and accepts the Seller’s public offer (i.e. the Buyer pays for the completed order on the conditions of the present Terms and of the sales and purchase contract). In case the Buyer performs payment in procedure set forth by cl. 4.4.1, a period is set forth for receiving the accept - 5 calendar days upon Order completion. Upon expiry of the period set forth hereby, the accept is deemed outstanding and the Order is canceled. Once the Order is completed it automatically receives an identification number (“Order N”).
4. Cost and payment order
4.1. The cost of the goods is indicated near the goods in the Internet store.
4.2. The Buyer pays for the order in any way selected in the Internet store.
4.3. The price of the goods in the Internet store can be unilaterally changed by the Seller. The price of the goods ordered by the Buyer is not subject to modification after the Buyer accepts the public offer.
4.4. Payment for the goods is made in AMD in the following ways:
4.4.1. Via bank transfer of the funds to the Seller’s bank account.
4.4.2. In cash in case of self collection of the purchased product from the Seller’s Sales and Customer Care office.
4.5. The payment order via bank cards is indicated in the Web-site in the section Payment for the Goods. Authorization of operations by bank cards is carried out by the bank.
5. Receipt of the goods
5.1. Upon completion of the Order the Buyer indicates the Seller’s Sales and Customer Care office from list placed on the web-site, where he wants to receive the Goods.
5.2. The Goods are self collected from the Seller’s Sales and Customer care office.
5.3. Upon receipt of the Goods the Seller’s representative has the right to require from the Buyer to submit ID document (passport or ID card), as well as to require to indicate the details (“Order N” etc) of the completed Order. The Seller guarantees the confidentiality and protection of the Buyer’s personal information (cl. 7 hereof ).
5.4. At the moment of receiving the Goods the Seller’s representative demonstrates to the Buyer the appearance and the completeness of the Goods. The Buyer gets the package of documents of the Goods upon receipt of the Goods:
§ Purchase and sale contract (if applicable);
§ Sales receipt;
§ All operation documents submitted with the goods;
§ Warranty certificate (if so provided).
The risk of accidental loss or damage to the goods passes to the Buyer at the time of transfer of the goods and the buyer affix signatures in documents confirming the getting of the order.
5.5 The Buyer confirms with signature in the document submitted by the Seller’s representative that he/she has no claims to the appearance and completeness of the Goods. After acceptance by the Buyer of the Goods the Seller does not accept any claim to the appearance and completeness of the Goods.
6. Replacement of the Goods
6.1. Replacement of Goods of appropriate quality:
6.1.1. The Buyer, in procedure set forth by RA law “On the protection of consumers rights”, has the right to require replacement of the goods within 14 days upon receipt of the Goods, and in case of sales on credit – within 7 days, upon the condition of not using the Goods, preserving its appearance, consumer attributes, seal, label and trademark or cashier's check, confirming the fact of purchase of the given Goods. The Buyer is obliged to apply to the Seller’s Sales and Customer Care office where the goods were received. The Buyer is not entitled to require replacement of the goods of appropriate quality, which are in the list of the goods not being subject to return, set forth by RA law.
6.2. Product Guarantee:
6.2.1. The Buyer, in the procedure set forth by RA law “On the protection of consumers”, has the right to demand elimination of defects in the goods or replace the goods of poor quality during the warranty period.
7. Personal data provision and protection
7.1. Upon registration on the web-site and/or completion of the Order on the web-site the Buyer provides personal data.
7.2. By providing person data upon registration on the web-site and/or completion of the order for the registration and/or conclusion of the Goods purchase and sale contract, the customer, defined by requirements by RA law, the Buyer gives his/her consent for their processing, using and transferring to third parties (including to other countries) by the Seller.
7.3. By registering on the web-site and or completing the Order on the web-site, the Buyer confirms that he/she is notified about the Seller’s intention to process, use, transfer to third parties (including to other countries) about the legal basis, purpose of processing, as well as about other information about notification set forth by RA law “On personal data”.
7.4. On the stages of personal data processing the Seller guarantees the confidentiality of the personal data, observance of personal data processing principles and rules set forth by RA law “Оn protection of personal data”.
8. Other terms
8.1. The relations between the Buyer and the Seller are regulated by RA law.
8.2. The Terms come into force from the moment they are placed on the web-site and are effective till the moment they are changed by the Seller, about which the Buyers are notified by placing the new terms on the web-site.
8.3. The Buyer confirms that he/she has familiarized with the present Terms and accepts them without reserve and in full.
8.4. Invalidity of any provision of the present Terms does not render invalid other provision hereof.
